Trial monitoring of cases related to organized crime and corruption under the new Criminal Procedure Code(2015)

Period of implementation: February 2015 – December 2015

The Coalition “All for fair trials” is implementing project “Trial monitoring of cases related to organized crime and corruption under the new Criminal Procedure Code” form February 2015 until December 2015, financed by US State Department and INL Justice Trial Monitoring Project.

Through trial monitoring carried out by experienced trial observers, we will obtain statistical data about the manner of implementation of the new Criminal Procedure Code (hereafter CPC) in different criminal procedures which will present basis for preparation of the final trial monitoring report. The final trial monitoring report shall contain findings and recommendations that should offer solutions for resolving detected weaknesses regarding the implementation of the new CPC. The report will also focus on the effectiveness of the responsible authorities in the fight against corruption and respect for the human rights and freedom as guaranteed by the Constitution and laws. According to the Coalition’s experience, reports which are produced through direct research are used as a serious tool by the professional public (judges and public prosecutors). Recommendations provided through the reports may lead to changes in the CPC in the future.

Goal of the Project

The overall aim of the project is to strengthen the independency, efficiency and impartiality of the Macedonian judiciary in the fight against corruption and organized crime and to contribute towards proper implementation of the criminal justice reforms with main focus on the new CPC.

The overall objective of the project is:

  • To assess the judicial efficiency through monitoring the implementation of the new CPC;
  • To establishing a system for early reporting of shortcomings in the application of the new CPC;
  • To assess the criminal justice response to fighting corruption and organized crime;
  • To estimate the level of respect for the fair trial standards;
  • To increase the knowledge of the professional public in the field of corruption and organized crime, in particular the novelties envisaged with the new CPC;
  • To increase citizens trust in judiciary and the justice system.


Project activities
:

  • To conduct a trial monitoring for total of 480 hours in thematic cases related to the criminal acts of corruption and organized crime;
  • To prepare quarterly updates regarding the cases and their compliance with the new criminal procedure code and internationally accepted fair trial standards;
  • To prepare and publish a final written trial monitoring report (available in 200 copies in Macedonian, English and Albanian languages);
  • To organize one round table with the relevant judicial officials that work in the area of corruption and organized crime (judges, prosecutors, lawyers and Ministry of Internal Affairs officials) and present the conclusions and recommendations from the report.
